Description

The Property Law of the Civil Code essentially reflects the previous legal framework, with several innovations that are primarily based on the regulations of the German (as well as French and Swiss) Civil Codes. Property Law (PrD) is the part of the Civil Law that regulates property rights, generally focusing on the relationships of control that an individual has over things (= tangible economic goods). As we will see below, the object of property relationships can also include natural forces or actions and rights. The PrD is part of property law. A prerequisite for the PrD is the recognition of individual ownership.

The PrD is of great importance both for individuals and for society. The significance of the PrD for the individual. With the PrD, the legal order responds from its side to the demand (and the inherent human need) for every person to be able to control economic goods (as the PrD precisely regulates the forms of this control). Apart from this, the PrD also regulates basic conditions for the development of an individual's economic activity (ownership, property security, etc.).

The significance of the PrD for society is self-evident, as the PrD regulates the resolution of conflicts of interest among the legal community regarding the control of economic goods, as well as fundamental conditions for the development of their economic activities (and consequently for the promotion of the social economy).
