"Forest Law and National Cadastre" represents a serious scientific effort to synthesize four branches of Law: Property, Cadastral, Forest, and Environmental Law. The forest phenomenon is regulated through the substantive and functional integration of these branches of Law.
The starting point is the Forest Law from 1836 to present. From the fundamental concepts and principles of the aforementioned branches of Law (e.g., the forest as real estate and as a land parcel, principles of sustainability and environmental development) to the most detailed regulations (e.g., approval of interventions in forests and forest areas for tourist facilities, as well as regulations regarding chestnut waste dumps), a complete journey through time (e.g., Law 998/1979, and Articles 153-155 of Law 4389/2016) and space (e.g., forests under land registration and forests operating within the Cadastre) is followed.
The various bodies (forestry and cadastral), their alternating responsibilities, their decisions (e.g., by the E.P.E.A.), the interests affected (Public or private), the succession of uncontested and contested evidence, combined with the highly important contribution of jurisprudence, create a field that directly interests every legal professional in practice or theory.
The resort to judicial decisions is predominant, including those of the Supreme Special Court, the Court of Cassation, and the Council of State, as well as other courts in general. A characteristic of Cadastral Forest Law is that it has been literally shaped under the influence of both older and more recent jurisprudence.
The entire work follows the constantly changing legislation (indicatively: Articles 17, 24, and 117 of the Constitution, Law 1650/1986, 2308/1995, 2664/1998, 998/1979, 3203/2003, 3827/2010, 3889/2010, 4389/2010, 4280/2014, 3937/2011, as well as Presidential Decree 86/1969, Council Decision 32/2016). The development of this systematic publication includes an Introduction and three Parts. It features, besides a comprehensive Table of Contents, two detailed indexes (of provisions and terms) to assist interested legal professionals, surveyors, and foresters.
This is an original contribution that synthesizes Forests with the National Cadastre.
