The writing of a book dedicated to the Law of the European Union, following the failure of the project to establish a European Constitution, aims to highlight the impressive resilience over time of the fundamental characteristics of the European legal system.
Although half a century has already passed since the birth of the most original and necessary European legal order, the data that characterize and guide it remain as strong as ever, even if they are constantly changing.
Unfortunately, or rather fortunately, this is the fate of European Union Law, which is called to serve a multidimensional historical perspective, the composition of a European State, a reflection and culmination of the best compositions that European culture has birthed.
As we emphasized in "Chapters of European Community Law" (2000), to which this book owes much, anyone engaged with European Community law should, following the example of historians, write their work in pencil so that they can continually erase and rewrite.
The endeavor of the treaty for the establishment of a Constitution for Europe demonstrates the truth of the matter. However, the attempt to write a "Law of the European Union" involves not only difficulties but also joys, stemming from the search for a new legal system that reflects and embodies the best European traditions.
