The adjudicative function is one of the classic issues in legal theory. In the international domain, the adjudicative resolution of international disputes is flourishing with the multiplication of international judicial and arbitral bodies, a fact that enhances the interpretation and application of international law. The intense activity observed in recent decades in the field of international justice provides an opportunity for reapproaching the adjudicative function in international law. The aim of this monograph "The Adjudicative Function in International Law" is to highlight the evolving nature of the adjudicative function within the international legal order.
The book is divided into two parts, the first concerning the adjudicative function of the international legal order and the second regarding the exercise of the adjudicative function within the international legal order. Thus, in the First Part and its individual chapters, all issues related to the evolving nature of the international adjudicative function, as well as the institutional organization of international justice, are analyzed. Specifically, the principle of state consent as the foundation of international adjudicative authority and its manifestations in the field of adjudicative resolution of international disputes is examined, while a separate chapter highlights the diversity of newer international bodies and the expansion of the fields of international jurisdiction.
Furthermore, in the Second Part, issues related to the law governing the exercise of the adjudicative function are presented. Specifically, in the individual chapters, the role of the international judge as a factor in the evolution of international law and shaper of the adjudicative function, as well as the role of international case law as a factor in the shaping of international law, is analyzed.
The last chapter places special emphasis on the concept of the adjudicative decision, and subsequently, the bibliography that complements the work is provided.
