This study aims to legally assess various attempts to override the Cypriot Constitution, essentially analyzing the entire constitutional history of the Republic of Cyprus.
Perhaps there is no other state where an attempt to exceed the constitutional text has been made so persistently and in so many different ways. From the rejection by the constitutionally designated authorities of explicitly stipulated constitutional provisions during the period 1960 – 1963, to the doubling of the constitutional order through invoking the law of necessity.
From the 1963 Turkish Cypriot rebellion, which sought to abolish the constitutional order, to the 1974 coup d'état aimed at overthrowing the constitutional order. From the Turkish invasion of 1974 and the occupation of 36.4% of Cypriot territory, to Turkey's ongoing efforts to establish two states in Cyprus in violation of the Constitution.
From Makarios' proposals to amend the Constitution in 1963, to the first revision of the Constitution through invoking the law of necessity. And from the effort to achieve a comprehensive resolution of the Cyprus problem through the vote on a new Constitution, to Cyprus' accession to the EU and the attempt to radically revise the Cyprus Constitution through a referendum.
It is evident that the effort to operate the Cypriot Constitution includes a parallel attempt to override the Cypriot Constitution. An override that was sometimes considered necessary to keep the Cypriot Constitution in force, such as the application of the law of necessity, and other times amounted to an attempt to abolish the constitutional order, such as the declaration of the "Turkish Republic of Northern Cyprus," or replacing the constitutional order, such as submitting the Annan Plan to separate referenda.
