Description

This is the second edition, augmented and completed, of the author's doctoral thesis on the ever-relevant issue of irrevocable power of attorney, which, by exception, cannot be revoked by the principal.

The work retains almost the original text and includes the latest developments, particularly the evolution of case law, immediately following the corresponding sections. The work consists of an Introduction, the first and second parts, and conclusions.

The Introduction presents the problematic of irrevocable power of attorney and is followed by a historical overview and comparative review. Then follows Part A and the General Part with the definition, prerequisites, absence of prerequisites, consequences, and cessation of irrevocable power of attorney.

Particular importance is given not only to the analysis of the interest of the attorney-in-fact or third party that justifies such a strong commitment but also to the specificity of the power of attorney and the waiver of the principal's right to revoke.

The relationship with the appointment of a substitute attorney-in-fact is also examined, and criticism is directed towards the prevailing opinion regarding the revocation of irrevocable power of attorney due to significant cause.

In Part B and the Special Part of the work, specific forms that appear in practice are examined, such as in a pre-agreement and in the construction of a building under the compensation system. Particular emphasis is placed on the inherited or posthumous irrevocable power of attorney, the validity of which has been disputed.

The work concludes with extensive conclusions and detailed indexes.
