The principle of legality is a fundamental element for the self-existence of a state entity, as it allows for survival and development. However, the concept of legality varies from state to state depending on the nature and origin of the legislation, which always invokes the idea of justice.

Thus, it is not surprising that regimes opposed to each other invoke justice, in order to legitimize their perpetuation in power. The issue becomes more complex when the core of legislation is religion, as opposition to legality then additionally becomes an opposition to the very wills of God, which are embodied in the law.

The following study examines this latter possibility, as it delves into the analysis of the dissolution of divine legality in two predominantly religious states, the Greco-Roman and the Islamic, and the ways of resistance to such an anomaly. This comparative study is enriched with the Platonic civic background, which, according to the author, has also determined the political choices of these legal systems.

This work, concise, original, and comprehensive, brings new insights and places the entire problematic on a new foundation, as both the author's original work and analytical ability add copious new elements to the existing related research.

It should also be noted that the author, strictly relying on legal texts, makes a highly interesting addition to Islam by introducing the term 'legitimate uprising', which he considers, under certain conditions, as an obligation of the faithful. Finally, the author's position that the events of the so-called 'Arab Spring' do not have a legal basis in Islam is significant, as they do not fall within the concept of legitimate uprising.
