Until a few years ago, the impact of European integration on family law seemed to be a matter of limited interest. However, the legislative process of the European Union since 1999 has completely overturned the previous situation and even more drastic effects are planned for the not too distant future.
The most important manifestation of this trend of "Europeanization" of family law was initially Regulation 1347/2000 on jurisdiction, recognition and enforcement of decisions in matrimonial matters and matters of parental responsibility for common children of spouses, and especially the new Regulation 2201/2003, which will start to be applied on 1 March 2005, and which replaces the previous one in its entirety, expanding its scope and bringing significant changes to the regulation of parental responsibility cases.
This study is the first to be published in Greek law with the subject of presenting and interpreting the provisions of the new Regulation, in relation to the (still applicable) regulation of Regulation 1347/2000 and especially with the concepts and institutions of Greek family law. Given the technical nature and discouraging complexity of the new regulations, the complete lack of case law (of the ECJ or national courts) and the very limited extent of foreign literature on the topics examined, the study is self-evidently useful. The book includes as an appendix the text of the new regulation and its explanatory memorandum.
