The litigant can implicitly accept a judicial decision, through acts or omissions that betray his clear intention to voluntarily comply with the content of the decision. Such behavior is accompanied by significant procedural consequences, as it leads to the rejection as inadmissible of the subsequent legal remedy that is exercised.
The study utilizes the rich case law and examines in detail all the cases that have arisen, leading to the establishment of specific criteria that assist the judge in characterizing or not the litigant's behavior as silent acceptance. For this reason, it presents notable interest both for theory and practice.
