With the proposed "Constitution of Europe," not only is a self-sufficient and unified political authority or political sovereignty in the European Union not being organized, but there are also no provisions for the establishment of a public, European political sphere or a European Municipality that would serve as the source of power or the supreme legitimizing foundation of all the powers of the European Union.

It merely confirms an international agreement to unite sovereign states that is not itself sovereign. The use of the term "Constitution" in this case is misleading, as it creates among other things the deceptive impression that the European Union is supposedly evolving from a "Union of States" into a "Union of Peoples," while the exact opposite is happening: the "masters" of European integration remain the states with their governments, and the method of governance through the Councils of Ministers, the newly established institution of the President of the European Union, and intergovernmental conferences is being institutionalized and perpetuated.

To politically unite the peoples of Europe, they do not need a pseudo-constitution but a real Constitution that will genuinely safeguard their sovereign rights, respect and not undermine their constitutional autonomy, their political and cultural identity, and above all guarantee, in an indivisible unity, the individual, social, and political rights of all those who wish to be legitimized to bear the status of European citizens, provided they share the constitutional terms of a common political life.
