Description

The present work examines the multiple aspects and challenges of the law governing international commercial relations, specifically that which is primarily influenced by the World Trade Organization and is at the core of International Economic Law.

Within the framework of a general introduction, the concept of International Economic Law is defined, while the factors of international economic relations (states, international economic organizations, multinational enterprises), the phases of evolution of the international economic order, and the New International Economic Order are analyzed.

The main part of the book details the law of the World Trade Organization divided into seven sub-sections. It begins with an introductory historical evolutionary context from GATT to the World Trade Organization (Section A), followed by an analysis of the institutional framework of the WTO (indicative topics: functions, structure, decision-making, etc.) in Section B, and the multilateral agreements on goods (Section C), such as the GATT of 1994, the Agreement on Anti-Dumping Measures, the SCM Agreements, TBT, SPS, and others. Furthermore, Section D analyzes the General Agreement on Trade in Services (GATS), while Section E discusses the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). The last two sections of the book (Sections F and G) include the Memorandum of Understanding on the rules and procedures governing the resolution of disputes (indicative topics: previous regulations and the negotiation framework of the Uruguay Round, institutional bodies, dispute resolution process, etc.) and the Areas not addressed by the WTO (human rights, international trade and competition, cultural diversity).

For the convenience of the reader and further deepening, the analysis of each topic is accompanied by a concise relevant bibliography, while at the beginning of the book, after the table of contents and abbreviations, there is a Table of Jurisprudence with the decisions of the WTO dispute resolution bodies that are referenced in the book.

The second edition of the book is fully updated with all current developments.
