This study identifies the challenges and provides answers to the following questions: 1. When does mutual trust end? 2. Where can the balance between blind mutual trust and mutual suspicion be found? 3. What are the questions arising from the recent case law of the Court? 4. How will the European project survive the crisis of mutual trust?
This analysis argues that, while the recent case law of the Court provides for cases that lead to the non-application of mutual trust, its approach remains that the rejection of this principle should only occur in exceptional circumstances to maintain the existence of the Area of Freedom, Security, and Justice.
Finally, it concludes that, given that the landscape has changed due to the crisis of values, the provision of rules for a new construction of the principle of mutual trust, thereby defining the exceptions to it, is more necessary than ever.
