Description

Description

Since June 2017, when the last 7th edition of the Bankruptcy Law by Professor of Law at Aristotle University of Thessaloniki, Spyros Psychomanis, was published, two years have passed during which new legislative changes (laws 4491/2017, 4512/2018, 4549/2018, 4554/2018, and 4605/2019) and articulated scientific positions and jurisprudential issues have continuously disrupted this field of law, which has not experienced a moment of calm since its radical revision in 2007.

The "excusable" debt of the debtor, the discharge of the bankrupt from the remainder of their debts, the "super-priorities" of employees, the changes in the specially privileged position of secured creditors, the restructuring of distribution tables, the filling of gaps in the pre-bankruptcy process of "special management," as well as the multitude of changes in the "pre-bankruptcy" field of over-indebted natural persons (non-traders) and the abolition of the protection of their primary residence, were the topics that prompted the author to once again undertake the revisory research endeavor.

Nevertheless, being aware and warning the reader for this reason that legislative changes—whether correct or not—will not cease, obliging the legal practitioner of theory and practice to remain in continuous alertness.
