The new, 5th edition of the classic textbook on General Obligations Law systematically records the knowledge that has been accumulated so far on this subject; at the same time, it attempts to subject this knowledge to critical scrutiny.
It engages with arguments and counterarguments, striving to contribute to the understanding of each legal rule and primarily to the acceptance of its interpretatively inferred meaning. The work is fully updated with the latest legislative and case law developments; over the many years that have elapsed since the previous edition in 2004, there has been significant scientific output in the field of Obligations Law, as well as rich case law.
Therefore, effort was needed not only to adequately consider this production and the newer case law (especially from the Supreme Court) but also to evaluate it, particularly on contentious issues. There have also been certain legislative changes, mainly of a union origin.
The developments that occurred in case law were, among other things, a consequence of the crisis in recent years, both economic and with many broader social implications, which caused difficulties in fulfilling contractual obligations.
These developments led, among other things, to a justified more frequent application of the general clauses of the Civil Code by the courts, particularly the principle of good faith, which allowed for the adjustment or even termination of contracts based on Civil Code Articles 288 or 388.
