The development of medical criminal law has progressed so significantly that many questions arise in this field (particularly the question of the patient's consent to a medical intervention), affecting both research and courts. This work highlights the similarities and differences between German and Greek law regarding the issues of consent and information disclosure.

Nevertheless, the problems and difficulties in clinical practice are considerable. In summary, it can be stated that the right to personality and self-determination of the patient should be respected. The consent of the individual should always be required for the physician to proceed with a medical intervention (surgery, treatment). The individual's will takes precedence over their well-being, and lawmakers must protect this autonomy.

At the same time, the trust relationship between the physician and the patient should remain intact. A norm should serve all these needs to overcome the problems and difficulties concerning the issue of patient consent and the physician's duty to inform.

The evolution of medical criminal law is so profound that numerous questions arise within it, engaging both science and judicial practice. One such question that raises particular interest is the patient's consent to any therapeutic intervention by their physician.

The aim of this work is to demonstrate the similarities and differences between German and Greek law regarding the issues of patient consent and the information provided by the treating physician concerning the patient's medical condition.

Nevertheless, the problems and difficulties of clinical practice are very significant. In conclusion, it could be said that the right to personality and self-determination of the patient must be respected. The patient's consent should always be mandatory in order for the physician to proceed with a therapeutic intervention (surgery, treatment).

The patient's will should take precedence over their health, and the legislator must protect this autonomy. At the same time, the trust relationship between the physician and the patient should remain untouched. A relevant law should serve all the above needs in order to address the problems and difficulties arising regarding patient consent and the physician's duty to inform the patient about their medical condition.
