The Association of Judicial Officers of the Council of State (EDL-StE), in its effort to bring to public discussion issues concerning the international legal community, organized on October 25, 2017, a symposium titled “The Dialogue between the Council of State and the European Court of Human Rights,” which was attended by members of the European Court of Human Rights, University Professors, Lawyers, and Judicial Officers of the Council of State.
This symposium, held in the welcoming Hall of Speech and Art at the Arsakeio Building, was a continuation of the symposium on April 22, 2013, which addressed issues that concerned the jurisprudence of the ECHR and the Council of State, particularly regarding the interpretation of provisions of the European Convention on Human Rights.
In the first session of the symposium, topics related to the ne bis in idem principle, foreigners and refugees, and the enforcement of judgments of national courts under the perspective of the jurisprudence of the ECHR and the Council of State were discussed. In the second session, the relevant presentations concerned the application for reopening proceedings, Protocol 16 of the ECHR, and the dialogue between the CJEU and the ECHR.
During the subsequent discussion in a friendly atmosphere, participants had the opportunity to express their opinions on the issues raised, confirming the particular interest in these topics at both national and European levels, as well as the expectation to broaden communication and intensify dialogue on matters related to the law of the ECHR.
This volume includes the presentations from the symposium, which have been supplemented with relevant documentation.
