The second edition of the book “Procedural Law in Greece” (1995) presents the significant changes to the Code of Civil Procedure of 1968/1971, which were imposed within the context of the country's economic crisis by Laws 4335/2015, 4475/2017, and 4512/2018, as measures to address some of its adverse effects, achieving simplification and thus speeding up civil procedures by all means. Although the main institutional concepts of the Code have remained intact, there has been a thorough revision concerning the procedures for conducting the first instance process, as well as the evidence methods to be produced.

Ordinary first instance procedures and, professionally, second instance procedures are now exclusively written, while the submission of witnesses is permitted only in exceptional cases. The possibility for parties to conduct many procedural acts electronically is also a significant innovation introduced by Law 4335/2015, which, however, has not yet been implemented on a large scale due to technical deficiencies. Additionally, the enforcement procedures for monetary claims have been nearly completely revised. Most enforcement acts now need to be carried out via electronic channels, including auctions since February 2018.

Along with the simplification of the revised enforcement process, the ability of debtors to oppose enforcement actions has been significantly limited. This book includes an extensive edition of the second edition of the 2019 monograph, which was originally published in the International Encyclopedia of Laws/Procedural Law, Wolters Kluwer, 2019. Therefore, this publication, like the first edition, follows again the detailed plan that has been elaborated by the editors of the series.

Furthermore, efforts have been made to enrich the original monograph with some more specific aspects of Greek Procedural Law, including references to recent Greek legal scholarship, many specialized monographs related to the imposed amendments, and some important recent judicial decisions. To date, the book “Procedural Law in Greece” remains the only comprehensive monograph of this scope dealing with the entire Greek Procedural Law in English or any language other than Greek. This second edition, which incorporates the radical changes to the structure of the Code of Civil Procedure 1968/1971, has been developed in the hope that legal professionals and legal theorists will consult it with the same level of interest as the first edition.
