Description & Specifications

The present work Philosophy of Law - Ancient Greek and Modern by I. Kareklas operates on five fundamental axes.

First, it highlights the inseparable connection between the Philosophy of Law, Moral Philosophy, and Political Philosophy. Second, it sufficiently presents the two major schools of thought in the Philosophy of Law, natural law and legal positivism. Third, it comprehensively examines ancient Greek and modern philosophy of law. Fourth, it proves and demonstrates that the Philosophy of Law permeates almost all branches of Legal Science. Fifth, this work addresses specialized issues in the Philosophy of Law in a distinct manner, such as the constitutional theory of political disobedience, the theory of revolutions, the theory and practice of political responsibility, and the issue of the death penalty.

Specifically, the content of the book is divided into three parts, namely in order: ancient philosophy of law, modern philosophy of law, and specialized issues of philosophy of law. In the first part, the origins of law and the equation of law and justice in ancient Greek thought, written and unwritten laws, the Sophists, ancient natural law (Plato and Aristotle's Politics), the analysis of Aristotle's Politics, the Nicomachean Ethics, and Hellenistic Philosophy with reference points to Stoic Ethics and Stoic Political Philosophy are examined and analyzed.

Subsequently, within the framework of the second part, Legal Positivism and Natural Law (modern period) are analyzed. Finally, in the third part, the constitutional principle of the separation of powers under the principle of Constitutional Theory and the principle of parliamentary sovereignty, the democratic principle, the political-constitutional theory of political disobedience, the constitutional contracts of political responsibility, the legalistic Aristotelian theory of revolution, and the death penalty as a historically ambiguous issue among theorists of the Philosophy of Law, Moral Philosophy, criminologists, constitutionalists, and others (the ethics of the death penalty) are presented.

The work is complemented and enhanced by a detailed index of words and terms found in the Philosophy of Law.
