Description & Specifications

Judges must adhere to the general, established notions regarding the nature of the authority assigned to them by the Constitution.

The moral reading asks them to find the best conceptual understanding of constitutional moral principles - the best understanding of what equal moral status for men and women truly requires, for example - that aligns broadly with American historical experience.

It does not ask them to follow the dictates of their consciences or the traditions of their social class or group, if these cannot be considered entrenched in this historical experience.

Of course, judges who may abuse their power might pretend to respect the important constraint imposed by integrity while actually disregarding it.

But generals, presidents, and clergy can also abuse their powers.

The moral reading is a strategy for lawyers and judges acting in good faith, and this is the content of the interpretive strategy.
