The points of intersection and distinction between two recent legal institutions, as regulated by the National Cadastre Law (L. 2664/1998) and the Mediation Law (L. 4640/2019), are attempted to be highlighted in this publication through thirteen legal professionals (academics, lawyers, mediators, heads of cadastral offices, and notaries) with their highly interesting studies.
This is to clarify which cadastral disputes can be subject to mediation and especially under what conditions the successful outcome of mediation may offer an alternative way to eliminate cadastral court cases.
In the appendix of the publication, the reader will find five records of successful mediation through which the correction of inaccurate cadastral records was achieved due to the absence of the true owner, correction of inaccurate cadastral records due to prescription, correction of inaccurate cadastral records due to inheritance through a will instead of the registered intestate succession, correction of inaccurate cadastral records of neighboring parcels through exchange of KAEK, as well as a record of successful mediation as a starting point for the implementation of sharing joint property.
