Description

Description

This concise work attempts a brief commentary on each article of the Code of Criminal Procedure. The findings of various theories and more exhaustively those of case law are presented succinctly. The classification of the material is systematic, allowing the reader to quickly locate answers to their questions under the corresponding article of the Code of Criminal Procedure.

The present 2nd edition was deemed necessary following the entry into force of the new Code of Criminal Procedure with Law 4620/2019 and the subsequent amendments, particularly with the governmental decree of June 27, 2019, and Law 4637/2019. The new edition critically tracks all legislative interventions related to the new form of the Code.

The transition to the new Code of Criminal Procedure also provided an opportunity for a reprocessing and updating of the case law issued in the meantime under the previous Code. Its presentation was deemed necessary to the extent that it could assist in the interpretation and application of the new Code.

Within the field of Criminal Procedural Law, a significant factor in its formation is also the case law of the European Court of Human Rights. In this work, efforts were made to include the relevant decisions (as much as possible) in the interpretative comments under the respective articles of the Code of Criminal Procedure.
