Description

The present second volume of the work Spatial Urban Planning Legislation, by G. Giannakourou, Associate Professor of the Department of Political Science and Public Administration at the University of Athens, aims at the most comprehensive possible collection and systematic classification of the provisions related to Building Law.

The legislative material of the work is categorized into seven thematic sections that correspond to: i) the general building rules, namely the provisions of the General Building Regulation, the Building Code, and the Seismic Regulation, as well as a reference to the main provisions for the Fire Protection of buildings, ii) building rules in specific categories of settlements, iii) provisions regarding out-of-plan construction, iv) provisions for the issuance of building permits, the control of construction works, the taking of safety measures during the execution of construction works, and the address of dangerous buildings, v) legislation for the transfer of building coefficients and related urban planning mechanisms, vi) provisions for unauthorized construction (process of classification, demolition, assessment of unauthorized constructions, and determination of fines) and construction overruns and changes in the use of buildings and structures, and vii) the general rules regarding environmental protection that govern the siting and terms of undertaking projects and developing activities.

In this last section (vii), the provisions regarding the construction of real estate and the operation of facilities in specific categories of areas, such as forests and forested lands, coastlines, beaches, port zones, habitats, streams, and generally water resources, archaeological sites, monuments, architectural ensembles, and traditional settlements are presented in tabular form.

Additionally, the provisions that regulate the establishment and operation of special categories of facilities are presented, including: industrial, artisanal, and hazardous facilities; quarrying and mining units, generally extracting units; poultry and livestock facilities and slaughterhouses; automotive service stations and workshops; fuel stations; health and retail establishments; supermarkets; school units and sports facilities; public entertainment businesses; health and social welfare units; tourist facilities; migrant reception centers; prisons and correctional facilities; cemeteries and crematoria; waste management units; energy facilities; antennas; advertising signs; shipyard and airport facilities.

The Collection is updated up to the recent laws N 3919/2011 (Government Gazette A' 32/2.3.2011) regarding engineers' fees and N 3937/2011 (Government Gazette A' 60/31.3.2011) “Preservation of Biodiversity and other provisions,” while the legislation presented in the volume, in the form of full text or tables, amounts to a total of 239.

The provisions of the work are fully updated with the most recent legislative developments and are accompanied by summaries of the basic case law and extensive notes of relevant literature and articles. At the beginning of the volume, a chronological table of the legislation of the work is presented, and at the end, a unified alphabetical index of legislation and case law. The work is aimed at any scientist, legal or otherwise, who deals with the study, analysis, and application of building law in Greece.
