Description

Since the latest edition of this book in 2012, a series of laws have been enacted, sometimes promoting new modifications to traditional labor legislation and other times amending recent amendments. It suffices to mention key ones such as Laws 4111/2013, 4133/2013, 4139/2013, 4144/2013, 4151/2013, 4152/2013, 4172/2013, 4225/2014, 4254/2014, 4255/2014, to verify the above observation.

This rich legislative production does not merely raise usual interpretative problems, as is expected, but also creates additional issues to investigate with the successive amendments: what exactly is valid and how to integrate them into the pre-existing legal framework. The two decisions of the Plenary of the Council of State, 668/2012 and 2307/2014, resolved the issue of constitutionality, but all other interpretative problems remain as expected, pending.

However, beyond these new interpretative problems, which the new edition of this book attempts to analyze, and the reference to recent jurisprudential solutions, an effort is made for a comprehensive evaluation of the reforms, whose fundamental philosophy is pervasive in other European countries. From this, it emerges that we are facing a new landscape of employment relations that gradually leads to the formation of a New Labor Law, with multiple changes in protection priorities, content, and ultimately in the nature of these new arrangements.

Accurate knowledge of these new orientations is an important interpretive tool for legal practitioners, and a necessary element for researchers seeking new labor rights, especially for those who believe that respect for labor is directly linked to development.
