The European Retiree represents the outcome of a challenging journey through the intricate pathways of the modern European social security landscape. It explores the institutional framework as well as the issues concerning the rights of freely mobile European citizens.
Specifically, the focus is on pension protection, which encapsulates the full functionality of the Regulation on the coordination of social security systems, as it affects all stages of an individual's life and their movements during that time.
Initially, the study examines which pension systems fall under the scope of Regulation 883/2004, which began to be applied on May 1, 2010, replacing the former Regulation 1408/1971. This examination is conducted in light of the different characteristics of existing pension systems across Europe, their reforms, and the broader developments related to the social function of these systems.
The analysis goes in-depth into pension benefits, as outlined in the coordination Regulation, with particular emphasis on distinguishing them from special non-contributory benefits. In this context, technical and substantive issues are analyzed, with practical and theoretical interest regarding the establishment of pension rights, pension calculations, and rules on overlapping benefits.
Much interest also centers on pension systems with funded characteristics, given the coordination with traditional pay-as-you-go systems. For this reason, a thorough presentation is attempted of the complexities created by integrating such funded systems into the coordination framework.
