Description

The fifth edition of "Inheritance Law", following a short period in relation to the previous one, was primarily imposed by Law 4335/2015 Official Gazette A' 87/23.7.2015, which includes urgent measures for the implementation of Law 4334/2015 (A' 80) that modifies the Code of Civil Procedure and, at the same time, amends, replaces, or abolishes provisions of the Civil Code.

Relevant regulations of the aforementioned law relate to the modification of the procedure for declaring a holographic will as primary when it designates exclusively a heir who is not the spouse of the testator or has no kinship with the testator of at least the fourth degree, and, on the other hand, following acute unanimous criticism of the theory, the abolition, indeed retroactively, of a recent substantive provision regarding inheritance law introduced by Law 4182/10.9.2013 "Code of Charitable Properties, Remaining Estates, and Other Provisions" (Article 77 I a), according to which "an alien is established as an heir of an estate that has no intestate heirs only with a public will."

The shaping of inheritance relationships in the present edition is evidently addressed also within the framework of Law 4356/24.12.2015 "Cohabitation Agreement, Exercise of Rights, Penal and Other Provisions", which institutionalized the cohabitation agreement between two individuals, regardless of their gender.

It was also deemed relevant to mention the institution of the European Inheritance Certificate, which came into effect on August 17, 2015, according to Article 64 of Regulation (EU) 650/2012 on inheritance relationships dated 04.07.2012, which was published on 27.07.2012.

The effort of the new edition has inherently considered the above recent legislative regulations, but it has also processed and enriched the work with the latest bibliography and case law.
