Description

The recent and ongoing amendments to the Civil Procedure Code raise numerous new issues and prompt the question whether procedural rules should also be changing at such a pace. Perhaps the continuous modifications of procedural rules in civil litigation create problems and ambiguities and do not always lead to addressing the endemic issue of slow justice in our country;

Along with many issues that arose from the mandatory initial mediation session, legal practice has become more bureaucratic at the expense of substance. Jurisprudence and theory always find ways and smooth out almost all extreme situations so that future lawmakers can address past shortcomings.

This presupposes that the law must first be "tested" in practice. Civil litigation in regular procedure has lost ground due to lack of oral proceedings, while in enforcement we see continuous upheavals. All these changes create serious legal uncertainty due to the dozens of amendments that have taken place over the last 50 years, averaging one legislative change per year.

All these questions and concerns were discussed within the framework of an Online Scientific Event of the Northern Greece Bar Association, held in February 2022 and presented here.
