The introduction of so-called autonomous systems (also known as: artificial intelligence systems) into everyday life, beyond the undeniable advantages they offer, involves numerous challenges across all areas of law, including civil law.

This study examines the issues of tortious liability arising in the case of damage caused by the operation of an autonomous car, that is, a vehicle that performs the dynamic task of driving, wholly or partly, without driver intervention.

After an introduction to the peculiarities of the relevant technology, the aim is to establish the liability of the involved parties in a traffic accident, namely the owner, the driver, and the manufacturer of the vehicle.

In the absence of specific applicable legislation, an effort is made to highlight the appropriate legal basis of liability among the issues related to resolving the problem.

Specifically, for the manufacturer’s liability, the liability of the producer for defective products is preferred, both general (see Civil Code 914, in conjunction with Civil Code 925) and specifically regulated (see Articles 6 and 7 of Law 2251/1994), while for the liability of the owner and driver of the vehicle, the specifically regulated civil liability from the operation of vehicles is favored (see Law ϡΝ’/1911 "Regarding the criminal and civil liability from vehicles"), as well as the supplementary application of general tortious liability (see Civil Code 914, in conjunction with Civil Code 922) for more comprehensive protection of those harmed.
