This short book gathers 7 studies. Their common theme is state arbitrariness and its criminal handling when significant individual freedoms and the value of human dignity itself are at stake.
The impetus for this joint publication was the recent decision of the European Court of Human Rights in the case of Zontul v. Greece, which is presented at the end of the book, and once again led to the condemnation of our country for violating Article 3 of the ECHR.
This time, however, not because of acts or omissions of the administration - or more precisely, not only because of these - but also because our criminal courts failed to correctly characterize the criminal behavior and impose a penalty on the perpetrators of the torture commensurate with the severity of their actions.
At the same time, the rights of the victim for information and participation in the trial were completely disregarded. The purpose of this publication is precisely to contribute to the correct application of the law.
