Description

The Special Part of the Law of Obligations regulates contractual (mainly contractual) and extra-contractual (tort and non-tort) relations of everyday social and economic life, with specialized application of the rules of the General Part where appropriate.

The relations governed by the Special Part of the Law of Obligations of the Civil Code are traditionally fundamental and common, and they are dealt with daily in practice. It is also important to note that traditional regulations of the Special Part have undergone amendments, influenced by modern theoretical concepts or the so-called "Union" Law of the European Union.

Regardless of the de lege ferenda position regarding these amendments, the modified rules constitute the current Special Law of Obligations under the Civil Code and make it essential for a lawyer to study and understand them.

This work attempts an interpretation of the Special Part of the Law of Obligations according to the Civil Code (not including special civil laws), based on theory and case law. It should be noted that jurisprudence, especially that of the Supreme Court, has significantly contributed to the systematic interpretation and application of the Special Part—and, indeed, with insightful theoretical analyses (as is shown by the references included herein).

The Special Part is examined in this book with the aim of presenting a system that will meet—within the limits of possibility—the needs of the theoretical researcher, the practical interpreter/implementer, and the student.
