Description

The challenging economic situation has unfortunately made the law on compulsory execution part of everyday economic life. In this social and economic context, the process of auctioning takes on particular importance, especially regarding the description of the seized property and the estimation of its value.

The study examines the problematic aspects of the legal remedies for the appeal for correction (954 § 4 of the Civil Procedure Code) and the requests for reduction-repetition of the auction (966 §§ 3-4 of the Civil Procedure Code), which are widely applied in judicial practice.

The long-term evolution of the two legal remedies from the period of the Civil Procedure of 1835 until today is examined, along with the procedural prerequisites for both, and an attempt is made to integrate the doctrinal issues that arise within the framework of everyday judicial practice.
