In this work, the entire range of substantive law (general principles of civil law, general and specific obligations law, property law, family law, inheritance law, general part of commercial law, company and negotiable instruments law, leasing, factoring, and franchising law, commercial agents law, trade representatives and distributors law, industrial property law, partnership law, trademark law, corporate name law, intellectual property law, and competition law, consumer protection law, personal data law, law protecting claims against credit institutions, suretyship law, banking law) and procedural law are covered. The focus is on those claims within private law that are sufficiently complex to grasp theoretically, and consequently difficult to apply in specific cases, making them also challenging for the enforcement judge to implement.
The judge will be ex officio obliged to identify the appropriate legal measures for each claim to be insured, in order to ultimately examine the critical issue of whether this measure results in or not a prohibited complete satisfaction of the claim in question.
This work provides a comprehensive examination of these claims, both in terms of their legal definition, the appropriate protective measure for each, and thirdly, whether this measure infringes the prohibitive clause or not.
