Description

Family Law differs substantially from other sections of Civil Law that constitute the so-called "property law," because these are individual-centered; they focus on the "individual" as a bearer of rights and obligations, as it operates within the framework of private autonomy. In contrast, Family Law is human-centered. At the core of its regulations is the person within the family, this social cell; the basic unit of production and shaping of individuals into personalities. This is why the Constitution (Article 21 § 1) states that "the family, as a foundation of the preservation and promotion of the Nation..., is under the protection of the State."

Over the last four decades, Family Law of the Civil Code has undergone significant legislative revisions to adapt to the rapid social, technological, and cultural changes, which have drastically and swiftly altered living conditions, ways of thinking, and cultural values within the social body.

It is therefore understandable that engaging today with this legal branch, as it has institutionally evolved in the new social and value environment, poses a particular challenge for the academic teacher and legal professional.

With this work, the author aspires to deliver to the legal community of the country a reliable and well-documented manual of the current Family Law, enriched with the most recent bibliography and case law, which constitutes a scientific work useful also to legal practitioners (judges, lawyers, notaries, registrars, etc.).
