The work "International Conventions on Liability for Oil Pollution (CLC) and Liability for Bunker Oil Pollution" addresses the issue of civil liability for marine pollution from oil. Since the accident of the Torrey Canyon vessel in 1967, this topic remains timeless and more relevant than ever. The subject of this study is the comparative examination and delineation of the scope of application of the International Conventions on Liability for Oil Pollution (CLC) and liability for bunker oil pollution, which have received widespread acceptance and have been successfully implemented at the international level, resulting in them becoming a reference point for international legislative work.
- In the first part of the work, the basic regulations of the two international conventions regarding liability and compensation obligations in the event of oil pollution are outlined in broad terms.
- In the second part, there is a mutual delineation of their scope of application, which is threefold: ratione loci, ratione materiae, and ratione personae. This delineation is made through the axes of convergence and divergence of the two international conventions. Among other things, the concepts of "pollution damage," "ship," and "oil" are examined.
- In the third part, the issue of regulatory redundancy is briefly presented, highlighting the overlapping zones of the two international conventions, examining the relationship that connects them, and evaluating the mechanisms they provide for addressing their overlaps.
The work is updated with the provisions of the KINDF (Law 5020/2023), mainly concerning special liability regimes for pollution, and serves as a useful aid for lawyers, maritime market executives, and legal professionals in general, who deal with maritime law, particularly the issue of marine pollution.
