This work explores international and European law regarding fundamental freedoms, with an emphasis on freedom of expression and its key manifestations. Through a comprehensive approach to human rights and the international and European mechanisms for their protection, this monograph aims to highlight the means currently available to ensure fundamental freedoms.

From international law to the European institutional-legal framework, this work addresses the legal principles and procedures that safeguard human rights, particularly the right to freedom of expression. More specifically, with an approach that combines theory and practice—through the examination of international European and Union case law—it analyzes the legal provisions and decisions of the most significant judicial bodies regarding key aspects related to the press, the internet, social media, and televised trials, and its conflict with other rights such as the right to privacy, to reputation, and to the presumption of innocence.

At the same time, it examines the requirements for the protection of personal data, as well as the restrictions imposed for reasons of public interest. Through the analysis of international treaties, legal provisions, and judicial precedents, this analysis seeks to present how legal science addresses the challenges in the field of fundamental freedoms and shapes legislative practices to ensure freedom of expression in a modern, digital society.
