A significant part of labor law is regulated by EU law, mainly through directives. Key concepts of labor law, such as remuneration, working time, business transfer, collective redundancies, etc., are concepts of EU law, which are authentically interpreted by the Court of the Union in the context of preliminary questions raised by national courts.
Without in-depth knowledge of European Labor Law, as shaped by the case law of the Court of the Union, legal practitioners are unable to address interpretative issues that arise during the application of national provisions that transpose EU law into domestic law.
In the period since the previous edition, there has been a rich production of case law material in almost all its thematic units, which is presented and analyzed in this new edition. The aim of this edition is also to present and systematically analyze, as fully as possible, the case law of the Court of Justice of the EU on the individual issues it addresses.
At the same time, there is a reference to national provisions that implement EU law, examining their compatibility with EU law. In addition to addressing new issues, such as those related to the posting of workers, all the issues dealt with in the previous edition have been re-examined, taking into account the relevant case law and theory.
This has necessitated a significant increase in the content of this edition compared to the previous one. With this material, the work ensures that legal practitioners acquire a deep understanding of the case law of the Court of the EU, serving as a valuable guide for the interpretation of both EU and national law.
