Description

27 profound contributions from judges, law school professors, lawyers, notaries, and heads of land registry offices compose the present 26th volume of the Library of Land Law, titled: "The Institution of Adverse Possession from the Field of Property Law to the National Cadastre System." They cover a wide range of critical issues related to the institution of adverse possession, combining aspects of modern civil (substantive and procedural) law with land law.

In particular, they start from the field of property law based on the Civil Code and special laws, addressing topics related to the prerequisites (time and succession in the possession of adverse possession; legal and presumed title; acquisition of servitudes through adverse possession; weakening of rights through adverse possession; adverse possession and the fate of property burdens; special adverse possession as per Article 4 of Law 3127/2003; redemption of privately owned property of the Greek State in relation to adverse possession) as well as the subjects concerning the examined institution (properties that cannot be subject to adverse possession; adverse possession on horizontal and vertical ownership, on property that has undergone expropriation or enforcement action, on beaches, on properties belonging to municipalities, on inheritance and plots, on ecclesiastical and monastic properties, on forest and grassland areas).

The aforementioned studies further focus on the realm of land registration: from the stage of land registration to that of the functioning cadastre (registration of ownership title through adverse possession; adverse possession under subsequent or finalized land registry entries), while, of course, they also traverse critical issues of adverse possession in land litigation (certainly and legally valid claims; defendant's defense; evidence; comparison of civil and land litigation; mediation; subjectively and objectively complex cases), as well as topics from the field of forced execution.
