The preparation of the updated new edition of this work was deemed necessary mainly due to the entry into force of the new KINDA in May 2023. The new themes of this edition include issues of ship collisions and applicable law, particularly when a Greek warship or a public service vessel is involved, and a new chapter has been added addressing the applicable international law concerning the establishment of jurisdiction and the identification of the applicable substantive law.
It also analyzes topics related to the liability of the shipowner, the person responsible to the shipowner, and the injured party, as well as the claims of injured crew members, passengers, and third parties against the owners of both ships involved in the collision, along with issues of a privileged nature, the extent, and the limitation of claims arising from ship collisions.
Furthermore, a new chapter on shipwrecks has been added to the work, which analyzes the concepts of wreck under Law 2881/2001 and wreck removal, the conditions and the process of its raising by the competent agency or the port authority, its disposal, the nature of the rights of the highest bidder, and other related issues.
Additionally, the new edition covers topics related to the protection of passengers in maritime domestic transport under Law 3709/2008 and the regime of maritime cruising under an organized travel contract, governed by the provisions of Directive 2015/2302. A detailed reference is made to the supplementary application of Regulation 1177/2010 regarding passenger rights in maritime and inland waterway transport in cases of death or injury, damage to luggage and valuables, issues regulated by the Athens Convention of 1974.
Moreover, among other things, a detailed reference is made to the invalidity of indemnity clauses. Finally, this revised edition significantly enriches the interpretation of the Hague-Visby Rules (HVR) contained in the section on the contract of carriage of goods and covers a significant gap in Greek literature.
Otherwise, this edition continues to maintain a concise approach, making it a useful tool for both practitioners and theorists of maritime law.
