Description

The initial cadastral registrations have been the main subject of regulation and the core of the provisions of the cadastral law. The engagement of theory and jurisprudence, from the enactment of law 2664/1998 until today, with the system of provisions of cadastral law (substantive and procedural) has been and continues to be exceedingly abundant, as evidenced both by the existence of hundreds of thousands of judicial decisions and the writings of representatives of legal theory. The issues arising from the interpretation and application of the law have also been numerous and have constituted points of intense scientific debate, while the conflicting opinions on the same legal issue (e.g., finalization of initial cadastral registrations) similarly highlight the importance and uniqueness of the provisions of the cadastral legislation.

We are approaching a critical milestone for the legal community and society in general, concerning a large part of the Greek territory, namely the expiration of the deadline for disputing the accuracy of the initial cadastral registrations and their subsequent finalization, with the well-known legal consequences, i.e., the deprivation of real property claims of the true owner, which are replaced according to article 7 § 2 of law 2664/1998 by contractual claims.

The long-awaited and eagerly anticipated new regulation, under law 5160/2024 (Government Gazette A’ 195/27.11.2024), article 36 §§ 1 and 2, which introduced amendments to article 6 § 2 of law 2664/1998, as in force pursuant to §§ 2 and 2A of article 102 of law 4623/2019 (Government Gazette A’ 134), as amended by §§ 1 and 2 of article 5 of law 5076/2023 (Government Gazette A’ 207/13.12.2023), granting an additional substantive extension for the correction of the first cadastral registrations, covering both the old cadastral surveys (before 2006) and areas where the correction deadline had expired on 30.11.2018, certainly gave great relief to many property owners, both private individuals and the Hellenic State, to correct possible errors and omissions in their properties, postponing the finalization of the initial cadastral registrations.

The fact that the finalization of the initial cadastral registrations, despite the rightly granted extension, is imminent, combined with the consequences involved in their finalization—which may in some cases remain inaccurate due to the inertia in correcting them by the true owners—brings to the forefront, with equal importance to the initial ones, the finalized cadastral registrations (article 7 of law 2664/1998) and led to the publication of the present work, which aspires to contribute positively to the scientific dialogue that has begun in theory and jurisprudence.
