Description

The recent unification of the first level of jurisdiction and the abolition of the magistrate courts (Laws 5108/2024, 5134/2024), with the resulting direct or indirect effects on the subject-matter jurisdiction of both first and second instance courts, as well as the recent, significant legislative interventions in the Code of Civil Procedure by the new Law 5221/2025, which systematically reorganized the regular procedure trial on a new basis, have made this fifth edition of the Handbook of Civil Procedure imperative. On this occasion, certain aspects of the issues have been revisited, some institutions have been systematically restructured, or even (partially) reformed. Of course, the intermediate developments in case law, especially of the Supreme Court and the Court of the European Union, as well as contributions from legal theory, have also been taken into account.

Key Features of the New Edition:

  • Complete Update: Includes all legislative changes up to early 2025, ensuring the validity of the information.

  • Systematic Structure: Follows the arrangement of the Code of Civil Procedure, covering General Provisions, Procedure in First Instance Courts, Legal Remedies, and Compulsory Enforcement.

  • Case Law Documentation: Enriched with the most recent case law from Greek courts (mainly the Supreme Court), providing solutions to complex interpretative issues.

  • Digital Justice: Extensive reference to the new provisions for electronic filing of pleadings, digital service, and teleconferencing in courtrooms.

Contents of Interest:

  1. Fundamental Principles: Analysis of the principles of fair trial and judicial protection.

  2. Ordinary Procedure: The new deadlines and the procedure for submitting pleadings and evidence.

  3. Special Procedures: Detailed presentation of disputes (labor, family, etc.) with their particularities.

  4. Interim Measures: The procedure and requirements for temporary judicial protection.

  5. Enforcement: The latest changes in electronic auctions and the seizure procedure.

Who is it for?

  • Lawyers & Legal Professionals: As a daily tool for drafting legal documents and representing clients in court.

  • Law Students: For preparing for undergraduate and postgraduate course exams, as well as exams for trainee lawyers.

  • Judicial Officers: As a reliable source for interpreting procedural rules.

Important Note:

The 5th edition of 2025 has been fully adapted to the requirements of the modern "acceleration of justice", making it the most up-to-date reference manual in the bibliography of Civil Procedural Law.
