This book examines cross-border jurisdiction conflicts in data protection law and how the fundamental right to data protection influences the exercise of extraterritorial jurisdiction by the EU. Governments, companies, and individuals are managing increasingly digitized personal data, making the protection of such data ever more important. At the same time, the Internet is changing how territory and jurisdiction are implemented online.

The EU promotes the protection of personal data as a fundamental right. Especially since the implementation of the EU General Data Protection Regulation (GDPR) in 2018, its data protection laws have significantly influenced areas beyond its territory. In contrast, similar privacy laws in the US are market-driven and have less regulatory weight. This has caused conflicts with the EU when their values, interests, and laws come into conflict.

This research uses three case studies to propose ways to resolve cross-border jurisdiction tensions related to data protection and security, free flow of information, and trade.
