The EU promotes the protection of personal data as a fundamental right. Especially since the implementation of the EU General Data Protection Regulation (GDPR) in 2018, its data protection laws have significantly influenced areas beyond its territory. In contrast, similar privacy laws in the US are market-driven and have less regulatory weight. This has caused conflicts with the EU when their values, interests, and laws come into conflict.
This research uses three case studies to propose ways to resolve cross-border jurisdiction tensions related to data protection and security, free flow of information, and trade.
