Description

This edition practically maps the development of criminal proceedings from the initial and introductory prosecutorial action to the issuance of judicial rulings at both first and second instance.

The structure of the work is organized into four standalone chapters, which follow the natural flow of a criminal trial. The first chapter analyzes the procedural prerequisites for referring the case and the actions of the prosecutor following the submission of a complaint, report, or information. It approaches through examples the distinction between preliminary examination, pre-investigation, and main investigation, as well as issues related to the rejection or archiving of complaints/informations. Special emphasis is given to the validity of the summons, the procedure of immediate arrest (auto), as well as investigative acts in cybercrime cases, including the procedural confiscation of digital data.

The second chapter thoroughly examines the trial process: the roles involved in criminal proceedings, appeals against the summons and the provisions of the prosecutor, the standing of parties supporting the prosecution, the presentation of independent claims, and changes in the charges. It analyzes the evidentiary process – witnesses, documents, defendant’s statements – the emerging use of technological means (Article 238A of the Code of Criminal Procedure), the reasoning of judicial decisions, and the tools of restorative justice.

Finally, the third and fourth chapters respectively present the procedures of remedies and practical issues related to the execution of criminal decisions, such as the conversion of imprisonment sentences, and the consolidation and suspension of sentences. The work is supplemented with indicative case law and practical notes, and has been updated to include the latest amendments to the CPP with Law 5232/2025, making it a useful and operational interpretative guide to criminal procedure.
