This work is based on the need for a systematic interpretative presentation of the provisions of the new CINS (Law 5020/2023); however, it is not limited to a simple recording of the new regulations. On the contrary, through a thorough assessment of case law data – focusing on English law as a regulatory point of reference – and the comparative utilization of international maritime practice, the research extends to the doctrinal elaboration of the charterparty institution.
The aim is not to provide a fragmented commentary, but to highlight a unified doctrinal framework capable of meeting the modern needs of the market. From this perspective, the monograph goes beyond descriptive depiction and critically examines established interpretative positions, seeking to form an updated interpretative model, with the expectation of becoming a useful tool both for the legal practitioner and for the scholar and applicator of maritime law.
This choice is justified not only due to the increased interest in charterparty law but also because of the need for systematic documentation of the significant changes brought about by the new law compared to the previous legislation and international practice.
