Following the favorable reception of the first edition of this work, which for the first time gathered the most significant templates related to the tax procedure in legal literature, as well as the judicial contestation of acts and omissions by tax authorities, the present second edition became necessary.
For the purpose of the new edition, all legislations needed to be adapted to the changes in both the substantive and procedural relevant framework. Thus, the related templates were appropriately revised, and new templates were added where deemed necessary. Furthermore, those templates concerning the provision of temporary protection were modernized.
All templates took into account and included the case law that emerged after the first edition, as well as the relevant decisions and circulars from the AADE.
The structure of the Work follows the following outline: The first section of the book, concerning the procedure before the tax administration authorities, is divided into three subsections: a) Views - Documents before the Tax Authority, b) Administrative appeals, c) Documentation of dividend acquisition from shipping companies. The second section includes templates of legal remedies and means related to judicial contestation and is divided into: a) Appeals concerning specific tax objects, b) request for suspension, c) appeal, d) cassation, e) third-party intervention, f) motion to set aside a judgment, g) request for revision, h) request for correction/interpretation, i) additional grounds, j) memoranda, and k) objections.
The work also includes a template for an appeal against a customs assessment act, as well as a template for an appeal before the European Court of Human Rights for a tax dispute.
Significant assistance is also provided in this edition by the interpretive comments and observations that accompany each template, further guiding the user in drafting each respective document.
The book "Templates of Tax Law" aims to offer immediate and practical assistance both to the practicing lawyer and to the more experienced legal professional who wishes to have a reliable guide consistently at hand.
