The presentations in this volume focus on the proposal of the Legislative Drafting Committee and the amendments introduced by the Bill for the New Inheritance Law.
This proposal foresees an extensive revision of all chapters of the fifth book of the Civil Code. With the new configuration of Inheritance Law, entire chapters of the law are abolished, such as the chapter on the heir with inventory or the disposal of inheritance, while two new important chapters are added concerning inheritance contracts made in contemplation of death and contracts of prior waiver of the right to inheritance.
The four most radical changes introduced by the new Inheritance Law under discussion refer to the introduction of inheritance contracts, the modernization of intestate succession, the reform of the statutory share, and the revision of the heir's liability for the obligations of the inheritance. Furthermore, significant in terms of number and content modifications occur in the provisions on the drafting, revocation, and publication of wills, the content of the will, disqualification from inheritance, judicial settlement of the inheritance, contribution, and the relations among heirs.
