In the present 30th volume of the Library of Land Registry Law titled “Good Faith in Land Registry Law,” Judge of First Instance and Land Registry Judge Aliki Giannatsi approaches the concept of good faith of the third party during the transfer of immovable property, focusing on the most important legal issues arising during the transition from the system of registrations and mortgages to that of the Land Registry.

Specifically, it examines how this transition at every stage, from the early phase of cadastral mapping to the finalization of the first entries, affects the scope and content of subjective good faith in transactions, which, as it intertwines with the substantive publicity of the land registry books, acquires new components, is upgraded and fortified to such an extent that it ultimately becomes the vehicle for the possibility of acquiring property ownership by a non-owner, the most fundamental innovation introduced by law 2664/1998 into our law, with the provisions of article 13 of law 2664/1998.

The structure of the study is based on a comparative review of the concept of good faith and its legal consequences during the transition from the system of registrations and mortgages to that of the Land Registry, emphasizing the emerging issues and the solutions prioritized as legally and politically more appropriate at a practical level, aiming to serve as a useful tool in the hands of the legal community and the study of the newly established Land Registry Law.
