Constitutional legislation should not (and must not) be solely the affair of the political class. In contemporary pluralistic democracies, the involvement of citizens in the process of producing the Constitution is crucial.
However, this does not mean that the institutions of popular participation in constitutional legislation are without difficulties and risks, both in terms of the potential manipulation of citizens, with the emergence of constitutional populism, and in terms of establishing regulations that appear attractive but may prove problematic.
Constitutional legislation is a highly serious matter. To lead to a successful outcome, the collaboration of the political class, civil society, and the scientific community is required. Primarily, it is essential to clarify the process, the principles, the method, the stages, and the criteria of constitutional legislation.
The search for the optimal content of the Constitution is not purely a political matter, where it is sufficient to clarify the substantive and procedural barriers to constitutional revision in order to decide on constitutional reforms. On the contrary, it requires the formation of rules and methodological tools that will guide the revising legislator in designing the Constitution.
Moreover, it is critical to broaden the circle of those involved in constitutional legislation, while clearly defining the processes and the role of each actor.
