Description & Specifications

The rapid development of electronic transactions and distance transactions in general has given new dimensions to the legal relationships between the parties involved, especially in commercial relationships, disconnecting them to some extent from the material element. The dominant focus is now on the economic exploitation of the object, deriving benefits from it, rather than its definitive incorporation into the property of a specific person through ownership. These developments in transactional practice have already been reflected in Greek law through a series of new types of contracts/forms (financial and time-based leasing, virtual pledge, floating charge, etc.), which focus not on a specific material object per se, but on its exploitation. This legal direction has also influenced the operation of the general clause of the Greek Civil Code, the interpretation and application of which by the courts is increasingly oriented towards the new socio-economic realities. This work is divided into two sections. The first section examines contracts or legal relationships characterized by special protection of use and economic exploitation of goods. The second part demonstrates, with the help of examples from the case law of Greek courts, how the prohibition of abuse of rights (especially in the context of commercial or quasi-commercial relationships) safeguards those who, through material control of the object, have contributed to its exploitation.
